NIS-2 Directive – implementing act signed by the President of the Republic of Poland

In response to the significant increase in threats in cyberspace, the European Union adopted the so-called NIS 2 Directive (Directive (EU) 2022/2555 of the European Parliament and of the Council of 14 December 2022). It is the successor to the 2016 NIS Directive, which aims to set higher and more consistent cybersecurity standards across the Union.

In Poland, the NIS-2 Directive is implemented through the Act of 23 January 2026 amending the Act on the National Cybersecurity System and certain other acts.

On 19 February 2026, the legislative process implementing the new law ended with the signing of the above-mentioned act by the President of the Republic of Poland. The document introduces numerous changes that adapt the Polish cybersecurity system to the requirements of NIS-2 and significantly expand the scope of duties and responsibilities of entities covered by the regulation.

The Act  will enter into force one month after its publication in the Journal of Laws.

Energy cooperatives in cities: a key amendment to the Renewable Energy Sources Act from the end of 2025.

On 16 October 2025, the Senate adopted the Act of 9 October 2025 amending the Act on the promotion of electricity generation in offshore wind farms and certain other acts. The Act was then signed by the President of the Republic of Poland. However, the Act has not yet been published in the Journal of Laws.

Among other things, this Act introduces a very important amendment to the Act on Renewable Energy Sources (Renewable Energy Sources Act, RES Act), allowing for the creation of energy cooperatives also in urban municipalities, instead of the previous possibility of creating such cooperatives only in rural or urban-rural municipalities. The amendment introduces a dual system for registering energy cooperatives (URE – for cities, KOWR – for rural and urban-rural municipalities).

PKD 2025 – Updating Business Activity Codes. What Should Entrepreneurs Know?

A few words about cable pooling

Cable pooling means the possibility for two or more renewable energy source („RES”) installations to share one and the same connection to the electricity grid. The provisions on cable pooling were introduced into the Polish legal system by the Act of 17 August 2023 amending the Act on Renewable Energy Sources and certain other acts (Journal of Laws 2023, item 1762) and have been in force since 1 October 2023.

Act on transparency of housing prices

May 21, 2025 The Sejm adopted the Senate’s amendments to the Act amending the Act on the Protection of the Rights of the Purchaser of a Residential Unit or a Single-Family House and the Developer Guarantee Fund and the Act on Competition and Consumer Protection (known in the media as the „act on transparency of housing prices”) and submitted the Act to the President for signature.

The basic assumption of the act is that the developer must inform on its website and on a special government portal (dane.gov.pl) – throughout the entire sales period – about: (i) the price per 1 m2 of offered residential units or single-family houses, (ii) the price of the associated rooms, if it is not included in the price of the premises or house (e.g. the price of a basement, storage room, garage), (iii) other payments,  which the buyer is obliged to make in the performance of the sales agreement.

In 2026, Poland will implement groundbreaking new regulations introducing mandatory gender quotas in the governing bodies of publicly listed companies. These rules are the result of the implementation of the EU Directive 2022/2381 of the European Parliament and Council, aimed at increasing the representation of women in management boards and supervisory boards.
